Administrative Procedure – Processing Public Concerns and Suggestions

Rationale

Glenbard High School District #87 adopts this procedure to ensure that:

        1. All persons having complaints concerning the school district will receive prompt, uniform
            and careful attention to those complaints; and

        2. Any employee who is the subject of a complaint will be protected from unfair treatment and
            frivolous, vexatious and repetitive complaints.

Informal Resolution

Glenbard High School District #87 encourages and expects complaints to be resolved informally by
those persons (parents, students, teachers and Administrators) most directly involved in the
complaint. No complaint will be processed under this procedure unless an effort has been made to
resolve the complaint informally or the person making the complaint submits a reason satisfactory to
Glenbard High School District #87 demonstrating that informal resolution is inappropriate.

Complaint Procedure

If informal efforts fail to resolve the complaint, the complainant will be given a copy of the complaint
procedure and the complaint form if the complainant requests the form or asks for an appeal of the
decision. If the complainant submits a completed complaint form within 5 school days after informal
resolution fails, then the Administrator receiving the complaint form will make an initial decision
within 5 school days as to whether the complaint requires further attention. The Administrator may
refuse to consider the complaint further if the Administrator determines that:

        1. The complaint is untimely, frivolous, vexatious or repetitive; or

        2. The complainant has not attempted informal resolution of the complaint or provided a
            satisfactory reason for failure to seek informal resolution.

If the Administrator refuses to consider the complaint further, he/she will advise the Superintendent
of the decision and its supporting rationale. The Superintendent will then make a final determination
as to whether the complaint will be considered further and advise the complainant and the
Administrator of this decision.

If the Administrator or Superintendent decides that the complaint will receive further consideration,
the Superintendent will designate an Administrator or Administrators to investigate the complaint (the
"investigator"). The investigator will consider any information submitted by the complainant and the
person against whom the complaint is made and may meet with either party, both, or other person as
the investigator determines necessary to understand the complaint.

Within 10 school days of the appointment of the investigation, the investigator will submit a report to
the Superintendent that will include a written summary of the investigator's findings and a proposed
disposition of the complaint. Within 10 school days of receiving the investigator's report, the
Superintendent will make a final decision on the complaint and advise the Administrator and the
complainant of this decision in writing. The investigator or the Superintendent may extend these time
limitations as circumstances warrant.

The decision of the Superintendent will be final.

Timeliness

A complaint will be considered untimely and will not be considered for further consideration beyond
informal resolution if the complaint form is not submitted within:

                1. Ten (10) school days of the event-giving rise to the complaint; and

                2. Five (5) school days after informal resolution fails.

Exceptions

This complaint procedure shall not apply to matters covered by other Policies and Procedures
currently in place or put into place to cover those matters including the following which are covered
by Policy 2:260:

        1. Title II of the Americans with Disabilities Act;

        2. Title IX of the Education Amendments of 1972;

        3. Section 504 of the Rehabilitation Act of 1973;

        4. Individuals With Disabilities Education Act, 20 U.S.C. § 1400 et seq.

        5. Title VI of the Civil Rights Act, 42 U.S.C. § 2000d et seq.

        6. Equal Employment Opportunities Act (Title VII of the Civil Rights Act), 42 U.S.C. § 2000e et seq.

        7. Sexual harassment (Illinois Human Rights Act, Title VII of the Civil Rights Act of 1964, and
            Title IX of the Education Amendments of 1972);

        8. The misuse of funds received for services to improve educational opportunities for
            educationally disadvantaged or deprived children;

        9. Curriculum, instructional materials, programs; or

        10. Provision of services to homeless students.

Absent unusual circumstances, further consideration will not be given to complaints that raise issues
generally committed to the classroom teacher's discretion such as grades and minor classroom
discipline.

If it appears at any time that the disposition of the complaint may include employee discipline, any
policy or contract covering such discipline shall be followed and shall take precedence over this
procedure.

Superintendent

As used in this procedure, Superintendent includes the Superintendent's designee.
